Town of Ulster may ban synthetic marijuana


The Town Board has scheduled a public hearing for next month on a proposed law that would criminalize the sale and possession of synthetic marijuana in the town. The hearing is scheduled for 7:15 p.m. Sept. 6 in the Town Hall. Town officials say the law has been proposed because of incidents that have put Ulster police officers at risk of injury. “The incidents escalated because of the effects of the drugs on the individuals,” said town Supervisor James Quigley.

“We had on incident in particular where it took three or four officers to restrain the guy after the guy had been Tasered twice,” Quigley said. “He was really feeling the effects of the drug, and not only did he put himself in harm’s way, this happened in the middle of (U.S. Route) 9W following a traffic accident ... (and) he’s putting of the officers at risk, too.” Under the proposed law it would be illegal to sell, offer for sale, deliver, knowingly possess, smoke, inhale, ingest, consume or be under the influence of any product containing any material, compound, mixture or preparation that contains any quantity of synthetic marijuana.

Synthetic marijuana is sold under such brand names as K2 and Mr. Nice Guy. Penalties under the law would be up to $250 and/or 30 days in jail for a first offense, $500 and/or 60 days in jail for a second offense and $1,000 and/or a year in jail for a third offense. Town of Ulster Attorney Jason Kovacs said the proposed law addresses weaknesses in recently adopted state regulations that ban the sale and distribution but not possession of synthetic marijuana.
